CMS CY 2027 Final Rule: Quick Overview for Agents

The CMS CY 2027 Final Rule streamlines agent processes while maintaining strong consumer protections. The focus has shifted from rigid timing rules to clarity, transparency, and consumer choice.

What’s Changed

  • Call Recording: Only calls that result in enrollment must be recorded. Marketing calls are retained for 6 years, while enrollment records remain at 10 years.
  • TPMO Disclaimers: Still required, but only before discussing plan benefits—no need to lead with lengthy disclaimers.
  • Scope of Appointment (SOA): The 48‑hour waiting period has been eliminated. Agents may discuss plans immediately after completing an SOA.
  • Events: Educational and sales events may occur on the same day, as long as transitions are clear and consumers have the option to leave.

What Didn’t Change

  • SOAs are still required
  • Misleading or deceptive marketing is prohibited
  • TCPA rules still apply
  • Consumers must always be able to decline or pause the conversation
